Addiction can become a matter of family law

Georgia families may find themselves facing a problem that continues to plague the nation as a whole. Addiction, considered by many medical professionals to be a disease, can sometimes become a matter of family law. If a person suffering from drug addiction has children, the children may be negatively affected by the actions of the parent, and other family members may face the difficult decision of attempting to take custody of a child. 

Recently, a Georgia mother, suspected to be under the influence of methamphetamine, became afraid that an unknown person was trying to harm her and that she was being stalked. Paranoia and confusion are established side effects of this type of drug. The woman took off in her car, 4-year-old child in tow, in an attempt to escape the danger she thought was real. Likely due to her altered state of mind, the woman did not buckle the child, and the girl was said to be rolling around the floor of the vehicle as her mother sped erratically through town. 

Police were able to contact the woman, and the child seemed to be frightened but not physically harmed. In her continued state of delusion, the mother thought an officer had assaulted her, but police cameras indicate this accusation was unfounded as well. The child was immediately taken from the mother and placed in the custody of family members. Her mother is now incarcerated and facing serious charges. 

When a family is ravaged by addiction, other members may need to act quickly to protect any children potentially in harm's way due to a parent's drug use. An attorney experienced in family law may be able to explain the process necessary to establish, modify or enforce a custody order. Though the procedure may seem complicated, an attorney can help explain to a court that a child is no longer safe with a parent, and that other family members may be better suited to care for the child.
